Payment Notice

A payment notice is the notice stating the sum the paying party considers due at each payment cycle and the basis for it — the anchor figure for that payment, in the absence of which the application stands as the amount due.

Where it sits: HGCRA 1996, s.110A. Due no later than five days after the payment due date (contract may vary); the consequence of failure is that the contractor\'s application becomes the notified sum.

The payment notice sets the number the cycle argues about. Give it, and the dialogue is at least between two stated positions; miss it, and the application stands unchallenged until a pay less notice — a narrower, later window with higher stakes. Chains that rely on pay less alone are chains that give away the first move every month.

Notices discipline suits housekeeping: due date, notice period, final date — the three dates that run every payment under the Act belong on a wall chart, not in someone\'s memory.
