Fluctuations

Fluctuations are contractual provisions that adjust the contract sum for changes in the cost of labour and materials over the contract period, transferring inflation risk from contractor to employer.

Where it sits: JCT 2016 offers fluctuation options (cl. 4.19-4.23, Options A-C); NEC4 uses Price Adjustment... secondary Option X1 (price adjustment for inflation).

Most main contracts are let with fluctuations excluded, so the contractor carries inflation. That is a pricing decision, not a law of nature: in volatile markets, contractors either load the risk into the tender or hedge it in the supply chain. Between 2021 and 2023, that dynamic repriced an entire industry.

When fluctuation provisions do apply, they are an audit exercise — indices, formulae, evidence of actual cost movement — and the commercial team that can operate them cleanly is worth its fee in the first turbulent quarter alone.
